Preface

In 2014, the Commission Against Corruption (CCAC), in strict adherence to the policies of laying stress on both punishment and prevention, sparing no efforts on investigation of every case and suppression of every corrupt act, strived to combat all kinds of corrupt practices, render recommendations to public departments and entities against administrative illegalities and irregularities and urge them to make remedies. Moreover, the CCAC continued to assist and cooperate with the People's Republic of China in the review on implementation of the United Nations Convention against Corruption (UNCAC) of the country conducted by experts of the United Nations. Meanwhile, the CCAC also actively participated in the review on Afghanistan's implementation of the UNCAC conducted by China. Moreover, in compliance with the regulation that requires the State Parties to legislate against bribing foreign public officials or officials of public international organisations under the UNCAC, the law Prevention and Suppression of Bribery in External Trade drafted by the CCAC was passed by the Legislative Assembly and entered into effect on 1st January 2015. The legislation has furthered the development of the criminal regime against corruption of Macao SAR.

In 2015, the CCAC will strengthen the cooperation with public departments and entities, maintain good communication with different sectors of the society, fully carry out its function of supervision by the rule of law and promote legal administration among public departments.


I. Anti-corruption
  1. Adhere to the principle of handling matters according to law, continue to enforce the law strictly and strive to prevent and combat corrupt practices, particularly in the strict supervision of public administrative activities prone to corruption crimes; moreover, strengthen the role in monitoring corrupt acts committed by the private sector and further enhance the communication and liaison with the judicial bodies in a bid to implement the sunshine government policy that every case is investigated and every corrupt act is suppressed.
  2. Due to the development of science and technology and the demand of anti-corruption work, strengthen the modernised and humane management and improve the internal administration and operation procedures; enhance the capabilities of supervisors to give commands; while extending the inherent team spirit, divide the work of investigators scientifically in order to maximise their potential; moreover, provide more technical support to investigators and improve the facilities and equipment needed during investigation so as to raise the law enforcement standard.
  3. Continue to promote the training for staff members, invite professionals to conduct themed seminars and internal training, cooperate with the training institutions from the Chinese mainland and countries abroad to provide the CCAC's personnel with different kinds of professional training programmes in order to continuously improve the legal knowledge of investigators and strengthen the investigators' capabilities concerning intelligence collection and criminal investigation techniques, particularly in enhancing the investigators' professional skills to use advanced technological means to conduct investigation, thus improving the efficiency and quality of case handling.
  4. Continue to make a study on the legal regime related to the duties of the CCAC; as the saying goes, "You can't make bricks without straw", thus, by summarising the law enforcement experiences of the past, promptly render opinions and recommendations on the improvement of relevant legal regime; exert full efforts to uphold probity in the society.
  5. Take initiative to follow up and cooperate with the Macao SAR to carry out relevant work on implementation of the UNCAC; reinforce the mutual case assistance in cross-border investigation according to law, promote the exchange on anti-corruption issues with other territories and judicial assistance with other regions in order to respond to the challenges brought by regional cooperation and globalisation.

II. Ombudsman
  1. Handle the requests for help and inquiries from citizens and respond to the inquiries relating to legislation and administrative operations of public departments.
  2. Carry out investigation on legitimacy and appropriateness of administrative acts and procedures of public departments and entities based on the complaints lodged by citizens to ensure lawful administration; enhance communication with public departments so they are aware of the problems in their operation and take corrective measures as soon as possible, so as to protect citizens' legitimate rights and interests.
  3. Conduct in-depth investigation into matters that have been most complained about or public administration issues widely concerned by society and closely related to residents' livelihood in collaboration with the relevant public departments; look into their operations and systems and give opinions and recommendations for improvement in order to increase the administrative efficiency and the quality of public services.
  4. When possible and necessary, review flaws in laws and regulations, particularly those detrimental to the rights, freedom, safeguards or legitimate interests of individuals.
  5. Continuously carry out training for personnel in order to upgrade their investigation and analysis skills and their ability to provide solutions to the problems in relation to the administrative operation of public departments.

III. Publicity and education
  1. Intensify integrity education amongst civil servants in order to raise their awareness of integrity and sense of self-discipline.
  2. Continuously promote the law Prevention and Suppression of Bribery in the Private Sector among private organisations and associations, in order to foster integrity management and business ethics in the private sector.
  3. Carry out integrity education for teenagers and citizens through diversified channels.

IV. Cooperation and exchange
  1. Positively participate in international/regional meetings and training to strengthen the professional knowledge of the CCAC's staff in the fields of anti-corruption and ombudsman, and enhance cooperation with its counterparts from across the world.
  2. Enhance exchange and cooperation with the Chinese mainland and neighbouring regions and learn from their successful experiences, with an aim to improve its structure and operation.
  3. Positively provide assistance in and support for the review of implementation of the UNCAC.

Conclusion

The CCAC will, adhering to its working principles and based on the achievements made in the past, further enhance its work on the fight against corruption, ombudsman, as well as promotion and education, foster integrity building in the SAR and develop a corrupt free society with the citizens.
